Welcome to Guitarhub. By accessing our website and using our 3D configuration software, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Platform Services and Role of Guitarhub
Guitarhub operates strictly as a Platform as a Service (PaaS). We provide advanced 3D visualization software that allows users to configure custom guitar specifications.
Guitarhub acts as an authorized facilitator and reseller for independent master luthiers and workshops. We transmit your design specifications and process payments on behalf of these independent manufacturers. Guitarhub is not the direct manufacturer of the physical instruments.
2. Intellectual Property & Trademark Disclaimer
All brand names, models, body shapes, and trademarks mentioned on this platform are used strictly for descriptive and compatibility purposes.
Guitarhub is NOT affiliated, associated, authorized, endorsed by, or in any way officially connected with Fender Musical Instruments Corporation, Gibson Brands, Inc., or any of their respective subsidiaries or affiliates.
Terms such as "S-Style" and "T-Style" are used to refer to generic, industry-standard form factors and do not imply any association with the original trademark holders.
3. 3D Visualization and Physical Reality
Our 3D configurator is designed to provide a highly accurate digital representation of your custom instrument. However, you acknowledge and agree that the 3D rendering is for visualization purposes only.
- Wood and Materials: Wood is a natural material. Variations in grain pattern, color, and texture are inherent and make every instrument unique. The final physical product will not be an exact pixel-for-pixel match to the digital render.
- Colors and Finishes: Display colors can vary significantly depending on your device's screen calibration. The actual paint or finish may appear slightly different in real-life lighting conditions.
4. Limitation of Liability
Because Guitarhub serves as a software intermediary:
- Manufacturing & Shipping: All responsibility for the physical quality of the instrument, manufacturing delays, shipping damages, and logistics lies with the independent workshop or the shipping carrier.
- Customs & Duties: The customer is solely responsible for paying any import duties, taxes, or customs fees levied by their respective country.
- Maximum Liability: To the maximum extent permitted by applicable law, Guitarhub’s aggregate liability arising out of or related to your order shall not exceed the total amount actually paid by you to Guitarhub for the specific transaction in dispute.
5. Deposits & 7-Day Hold Policy
To begin the consultation process, a fully refundable $100 deposit is required. This deposit is processed as an authorization hold on your payment method. If we are unable to fully agree on the custom order details within 7 days, the authorization hold will automatically expire and no funds will be captured.
6. User Responsibilities & Age Restriction
You must be at least 18 years old, or have the explicit consent of a parent or guardian, to place an order on Guitarhub. You agree to provide accurate contact information (Email) during the checkout process. You acknowledge that your final order will be built exactly to the specifications submitted in your configuration snapshot.
7. Production Timelines & Force Majeure
Custom instrument manufacturing is a time-intensive craft. By placing an order, you agree to the following:
- Estimates Only: Any production timelines provided (e.g., 6-12 months) are strictly estimates. They do not constitute a binding deadline.
- Force Majeure: Guitarhub and our partner luthiers are not liable for production or shipping delays caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics, strikes, or global shortages of specific woods and hardware. Such delays do not constitute grounds for order cancellation or refunds.
8. Governing Law & Jurisdiction
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ireland (European Union), without regard to its conflict of law provisions.
You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts located in Ireland.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
